CLARIFICATORY GUIDELINES ON THE TRANSITION PERIOD FOR THE IMPLEMENTATION OF THE LOWERED 100kW ELIGIBILITY THRESHOLD ESPECIALLY FOR RETAIL AGGREGATION PROGRAM (RAP)

To ensure uniform application of the eligibility of Retail Aggregated Groups (RAGs) and the switching process by all concerned stakeholders, in light of the effectivity of the 100kW eligibility threshold for the Retail Competition Open Access (RCOA) and RAP, the Commission issues the following clarifications:

1. Pending RAG application under the previous 500kW threshold

The RAG intending to switch under the previous 500 kW eligibility threshold and submitted its Letter of Intent (LOI) prior to the promulgation of ERC Resolution No. 22, Series of 2025, or during its transition period, from 4 November 2025 to 26 March 2026, even if some of the aggregated members individually meet the 100kW eligibility threshold.

The RAG may continue to proceed with its switching application under the previous rules, including the participation of end-users that individually meet the 100kW threshold, subject to compliance with the applicable transition provisions of ERC Resolution No. 22, Series of 2025.

2. Switching after 26 June 2026 due to Distribution Utility (DU)-/Retail Meter Service Provider (RMSP) attributable delays

The RAG falls under Item 1, but the switching requirement is completed on or after 26 June 2026 solely because of delays attributable to the concerned DU/RMSP (e.g., unavailability of metering facilities, transfer of service, failure or delay in the execution of agreements, or other distribution utility-related requirements beyond the control of the End-user or Retail Supplier).

The RAG may still be allowed to proceed with its original switching application, and may still be switched as such, under the regular or off-cycle switching process.

3. Switching after 26 June 2026 for reasons not attributable to the DU/RMSP

The RAG falls under Item 1, switching requirement is completed on or after 26 June 2026 only and for reasons not attributable to the DU/RMSP.

The rules in effect at the time of switching shall apply. Accordingly, End-users already meeting the 100kW eligibility threshold shall be considered individually eligible to participate in the Competitive Retail Electricity Market (CREM) or the Green Energy Option Program (GEOP), as applicable, and shall no longer be considered in determining compliance with the 500kW aggregation threshold. Consequently, the AG shall reassess its composition and eligibility under the applicable rules before proceeding with the switching process.
